Abstract

This article deals with investigating work on digital platforms, with a focus on crowdsorcing. This is because work on digital platforms can be classified as marketplace, collaborative economy and crowdsorcing, with the latter providing various services, the most common in Spain and Brazil being transport and delivery, practiced by the companies Cabify, Deliveroo, Freenow, Glovo and Just Eat, which register thousands of workers, without granting labor rights, considering them as self-employed. It turns out that the absence of labor regulation; the lack of knowledge about platform companies and technological capitalism itself, end up withdrawing labor rights historically conquered by the working class, affecting in different ways those who work
in northern and southern continents. The choice of Spain is justified because in this year of 2021, the Riders Law was approved and entered into force, which, by modifying two articles of the Workers’ Statute, legislation like the Consolidation of Labor Laws in Brazil, with articles on algorithmic governance and presumption of employment for digital platform deliveries, he led the legislative advance in matters of work on digital platform, which Brazil remains distant. Thus, with Brazil having thousands of workers active as digital platform couriers until the month of November/2021, this study aims to compare recent Spanish legislation with the situation of Brazilian platform couriers, with a focus on labor protection for this class of workers.
