Abstract

The binary model for classifying workers in terms of the legal nature of the relationship established in labor relations predominates in Brazilian legislation: autonomy or CLT subordination. The relationship established between workers and companies in the work model mediated by digital applications (uberization of work), such as drivers and delivery men, has caused controversy in the legal community and uproar in Brazilian courts. Jurisprudence is divided between the Regional Courts and the Superior Labor Court (TST). This text aims to analyze a recent monocratic decision handed down
by the Federal Supreme Court (STF) in the context of a Constitutional Complaint, in the case of the uberized work model, and other relevant and very current decisions considered pertinent to the topic.
