Abstract

The work focuses on new technologies that have been used to collect personal data from job candidates, along with social networks, for advance profiling of workers who, despite the best professional qualifications they have, may suffer “prior cancellation” from potential employers, solely as a result of exercising their constitutional right to freedom of expression. The normative instruments adopted by the European community will also be examined, as well as the means of legal protection established by the Labor Code and the General Data Protection Regime (GDPR), in Portugal. Finally, the challenges
posed by data protection fraud strategies will be addressed, through the use of artificial intelligence.
